Association response to The Oaks Ranch redevelopment

I am replying on behalf of the Broulee Mossy Point Community Association (BMPCA) concerning the proposed development of Oaks Ranch. Thank you for the opportunity to comment on the proposal. The BMPCA has not met because of the restrictions associated with the Covid virus however the Committee has considered the proposal and has raised a number of questions which it considers the Association would need to have a better understanding before it could come to a view about the proposal. Broader Planning:
We now have a lot of proposed housing development in this area of the Shire. Oaks Ranch, Rosedale, Bevian Road, Rosedale, completion of Tomakin, Broulee, Mogo. What analysis has been undertaken to estimate demand and to ensure that Shire infrastructure is not overwhelmed?
Is there going to be anything special about the housing development that creates something particularly attractive for the local community? For example the Estuary Estate promoted large blocks, quality homes quiet streets and private living.
 
What guarantees are there that the development will proceed as proposed? There are past examples of grand designs being approved but the eventual development being much less grand?
 
The Plans:
There are no compass points on the plan nor are local roads named, nor waterways labelled. This makes it difficult to understand how the proposal fits with the existing developments, particularly the Estuary Estate.
 
Traffic:
The proposal mentions that the design will be such as to control traffic using the development as a rat run though the Estuary Estate to George Bass Drive. When the development is complete there could be upwards of 1000 people staying in the estate. This alone will produce substantial traffic through roads in the Estuary Estate that are not designed for this traffic flow. This could be prevented by making the Old Mossy Point Road the main entrance for the development with traffic through the Estuary only permitted in an emergency.
How will construction traffic be managed so as to avoid problems for the Estuary Estate?
 
Block size and design:
There is no indication of the average block size. Will this be just another development of small blocks and boring houses like other Shire developments. This would be out of keeping with the Estuary Estate.
A mix of block sizes from 2 acre to 600 square metres would provide an interesting development with great variation in house design and garden development. It would also mean the development is more in keeping with the adjoining Estuary Estate.
Will roads and blocks be designed to facilitate solar access and reduction of non-renewable energy use?
 
Landscaping:
Are there landscaping plans including vegetation buffers and plantings to maintain the amenity of the Estuary Estate?
 
Pollution Control:
Golf courses are a recognised source of pollution largely because of heavy fertilising. The proposed golf course is on the banks of the Tomaga River. What are the plans to protect the river from pollution from the golf course and other elements of the proposal? There is currently concern about existing pollution from Mogo Zoo upstream.
 
Biodiversity Conservation:
The information from the website is particularly meagre. What did the ecological studies identify in terms of threatened habitats and species? What sort of protection is proposed for wetland areas?

Community Consultation Request Letter

Dear BMPCA,
 
My wife Lisa and I are the owners of the Oaks Ranch at 340 Old Mossy Point Road, Jeremadra. I’m not sure if you are familiar with our property / business or aware that we have been a long time in the planning for a proposed redevelopment of the property.
 
We are writing to you to advise that we have initiated a community consultation process to present the project to the community generally and to relevant stakeholders such as the local Broulee Mossy Point Community Association which I understand that you represent.
 
After many years of planning and undertaking numerous studies for ecological communities, bushfire, flooding, traffic and economic feasibilities etc, etc we are now in the final stages of the design development in readiness to submit our development application (DA) to the Eurobodalla Shire Council (ESC) in the coming months. Prior to the submission of the DA we are seeking feedback on the proposed development and will take into consideration any comments / feedback either supportive or critical, and will endeavour to address any issues raised prior to the submission of the DA.
 
The Oaks Ranch and Country Club (as it is currently known) has been trading since the early 1970’s with mixed success. The current owners have been partly involved since the early 2000’s and more recently we acquired outright ownership of the property. During the time of our involvement, the business has rarely covered its costs and is desperately in need of major upgrade and redevelopment. The recent bushfires and CV-19 have just added to the difficulties that the business has faced and it is currently closed for trading other than our Golf Course.
 
We have prepared a masterplan to redevelop the Oaks Ranch into a state of the art tourism, residential and resort community and to enhance the tourism offering for the Eurobodalla Shire and the greater South Coast of NSW. The facility will incorporate an upgraded boutique motel with 24 motel rooms and with Food and beverage services, function and conference facilities to service up to 200 guests / delegates. The proposed development includes 75 short stay resort style villas wrapped around a world-class 9-hole golf course designed by Greg Norman Golf Design.
 
The resort facilities will include a pro shop, tennis courts, swimming pool, a day spa, ancillary retail and convenience outlets set in landscaped open space and parklands. The overall project will also incorporate 90 architecturally designed homes set within a master planned landscape estate with significant measures taken to protect our native vegetation, flora and forna communities and wetlands areas. The project works will be staged according to the market up-take and we would anticipate a 2021 commencement for stage 1.
 
Due to the CV-19 pandemic and the requirement for social distancing, we have created a dedicated website to enable the Mossy Point / Broulee and surrounding communities to review and understand the owners’ current proposals for The Oaks Ranch and the overall Project details and to facilitate community feedback, comments and suggestions which can be considered and possibly included in the Development Application process, to address community concerns and to potentially improve the proposed development.

  Minutes of Quarterly Meeting 13th February 2020 at Broulee Public School 

Acting President Andrew Bain opened the meeting and announced that the meeting format would be deferred until after Kelwyn White, the local RFS community liason officer had spoken and answered questions.

In welcoming and introducing Kelwyn,  Andrew identified some key concerns from the feedback sought by BMPCA to the bushfire emergency.  
These were infrastructure failure, and little or no information, hazard reduction, education and evacuation centres.
The main points addressed by Kelwyn :
The distinction between RFS who fight fires and emergency management covering all other services such as SES and Council, led by Police.
Identifying Special Fire protection facilities such as schools, nursing homes and tourist facilities for specific fire fighting effort and allocation of assets.
The response to the leave early message promoted by the RFS after findings from the Royal Commission into the Victorian bushfires in 2009 and the importance of having a “plan” A key message in community education.
Explanation of hazard reduction guidelines and the 10/50rule applying to one’s own property, also ways of dealing with neighbours who do not manage their property for bushfire risk, using the bushfire hazard complaint procedure.
Lack of information, no power,internet, mobile phone and local ABC the emergency broadcaster was off transmission. Need to let the community know of other ABC transmission bands,. 
A community newsletter was posted on the fire shed daily during the emergency.  BMPCA need to take responsibility for a community response in the future to have information displayed in a central location ie the community notice board
Residents should be familiar with the Community Protection Plan for Broulee, Mossy Point and the Estuary estate, when preparing their property and making a plan. The protection plan needs to be clearly displayed at a central location in the community, it is available on the RFS website www.rfs.nsw.gov.au
Kelwyn encouraged the community to become more interactive and supportive of the local brigade and view it as a community hub.

  6. Francis Street footpath – to be constructed in November, all affected landholders notified, but decided without Association consultation. To discuss with ESC.
  7. Request to Council via letter for a council officer to attend this meeting was deemed unnecessary, as issues relating to the “open space” to the west of Captain Oldrey Park have been extensively considered, but the Association have been offered a meeting with a Council officer for further discussion if desired. The meeting agreed that Andrew, Barbara and Ross attend this meeting and to also raise the Francis St path.

Letter written to Minister for Planning over concerns BMPCA has for area on Captain Oldrey Park concept plan indicating open space, which ESC states is for residential development as signed off on the master plan. Concept plan not final, planning decisions are covered by the master plan.

Request for further letter be sent from BMPCA to ESC stating the strong community view and expectation was that the “open space” in the concept plan for COP was not for housing.

A wide ranging discussion followed on the need to push for a regional sporting complex with Council and State government, not Captain Oldrey Park, except for Netball, but an area with more space such as Gundary Oval or the Rosedale development. Need other sporting bodies on-side, and discussion with district sporting associations. Suggestion to invite Matthew Neason to speak to the next meeting on recreation matters.

Concern raised about the safety of a new access driveway onto Annetts Parade, Mossy Point. To be monitored.

Art on the Path, Sunday 6 October. BMPCA to BBQ, volunteers – Derek, Richard, Ross, Vince. To start at 8am.

Letters tabled from Broulee Public School, raising concern over the extent of bushfire mitigation clearing. BMPCA and the local Landcare group have supported the school in environmental weed removal and cooperated on retention of the Bangalay sand forest campaign for Captain Oldrey Park. Proposal for letter to be sent to the Principal supporting the school community’s concern.

Broulee Bay to Breakers swim booked for 8 March 2020 with more competitors and more volunteers required from BMPCA.

Brief discussion on new “Dogs on Beaches” signage how to educate visitors.
Suggestions – approach local real estates to include information and link to ESC website for holiday renters, and beach maps for local area.

President’s Report The President characterised the year as fairly quiet, involving
strategic planning.
Captain Oldrey Park master plan was signed off by Council, and the accessibility
Nature Trail has been roughed out by the sub-committee with a funding grant
available in the current financial year.
The Association approached Banksia Village to propose a joint funding contribution
to a pathway project offering safer access from Heath St to Broulee supermarket and
PO. No donation discussed, as waiting on a cost estimate from Council who will do
the work but do not regard it as a priority. The cost estimate has just come to hand
at $25-30K.
Other issues addressed during the year, Nth Broulee amenity – bus shelter, access
steps to viewing platform and road drainage on Coronation Drive and Broulee Rd.
The President closed with a plea to maintain the community association as it serves
to benefit the local community, is a vehicle to speak to Council in a cooperative
atmosphere, and has an annual meeting with senior staff to raise local issues. A
suggestion to be followed up via the website is to have links to other local
community associations in the area.

Correspondence
Letter from Allan Jevons seeking BMPCA support for ESC to amend angle of footpath at top of hill at Annetts Parade/Coronation Drive intersection. It is particularly dangerous for mobility scooters. BMPCA supports Council finding a solution to the matter which has been raised on a number of occasions by BMPCA members in the past.

Treasurer’s Report
$1,005 in Pathway account
$6, 492.68 in General account. This includes refund from Council for fees charged by Department of Lands for Sandcastle Competition and 2019 membership fees which are due.

General Business
  • ESC 2019/2020 Budget available for public comment. $50,000 earmarked for trail through the Captain Oldrey Park bushland. BMPCA Captain Oldrey Park subcommittee carried out a walk through at the end of March with Emma Patyus (ESC Landcare Co-ordinator) which identified an environmentally sensitive trail and possible areas for seating. BMPCA will need to keep pressure on ESC to ensure that identified trail minimises damage to vegetation.
  • Secretary met with Banksia CEO to identify linkages to the village. The footpath from Heath Street into Grant Street on the western side was raised as presently Banksia residents need to cross the road twice when visiting the Post Office. President has discussed this path with ESC Director Engineering, which would require removal of oleanders, of which there was little concern. ESC to prepare costing so that BMPCA can consider contribution. Banksia has committed to a contribution of funds.
  • Proposed seat at Heath Street and Grant Street intersection was also raised. ESC is currently refurbishing street seats and it will advise when available.
  • Stormwater ponding at western corner of Grant Street and Broulee Road intersection after rain needs assessment.
  • Ongoing issue of Lake Broulee stormwater ponding raised. ESC is looking at solutions which do not involve drainage to the heavily used Candlagan Creek beach.
  • Concern about graffiti on shared pathway north of area where donated bricks are located. Also, issue about sand and vegetation encroaching on bricks.
  • BMPCA Executive met with ESC General Manager and Directors as part of annual discussions about local matters. Considerable disagreement with Council about zoning of private land west of Captain Oldrey Park. Broulee Development Plan identifies this as open space but ESC maintain that it is zoned residential. Agreed that letter should be sent to the Minister for Planning outlining BMPCA concerns.
  • Letter received from David Hunter (ESC) concerning relocation and replacement of bus shelter at North Broulee. Members agreed that it is currently a difficult location for path users. Work is expected early in June. A number of issues in the general North Broulee area were raised including the unstable steps to the viewing platform, poor drainage at the shower which leads to sand buildup and visitors then washing their feet in the dog water at the water station (which then fills up with sand) and stormwater ponding at the corner of Coronation and Candlagan Drives after heavy rain. It was agreed that BMPCA should write to ESC to see if some of these matters can be addressed at the same time as the bus shelter construction.
  • Broulee to Breakers Swim in March achieved record number of swimmers. Thanks to all BMPCA members who helped with various tasks, particularly registration and finishing. Swim committee is looking at a different approach to handling the finish as numbers increase which will mean that BMPCA will need more helpers on 8 March 2020. A cheque for $5000 will be sent to BMPCA for its help – definitely our best annual money raiser!
  • Landcare to inspect outbreak of spreading Gazanias in Iluka Street and Zanthus Drive as well as sand and vegetation covering pathway bricks.
  • General concern about the size of Eurobodalla Shire Council and the number of business activities where Council is competing with the private sector. What happened to roads, rates and rubbish?

General Business and President’s report.

1. Letter on behalf of the Association to commend Council on the Tomakin road roundabout project, and request for it to be planted in line with other roundabouts in the Shire.
2. Report on Moruya airport runway upgrade, for information.
3. RLS update, on letter writing campaign and decision by NSW Dept. of Planning still pending.
4. Captain Oldrey Park [COP] Nature Trail .
From the Masterplan “ work with local Landcare group and Broulee Public School to design and establish a compacted gravel, accessible trail for education and recreation purposes through the trees. Perform risk assessment of trees for retention”. The meeting determined to proceed, a subcommittee was formed : D.McCann, S. O’Keefe, L.Bain, S.Needham with others to be co-opted as needed. Need to liase and involve BPS.  To request mature tree survey report from Council.
Ross Hayward explained the survey pegs, which are for a new rising main [sewer]. He also spoke on the need for an efficient car parking plan to minimize the need to move the netball courts North and clear more trees. The President  proposed a meeting with Gary Bruce ESC Manager for Development Control, including Engineering and Recreation representatives.
5. Future Projects for BMPCA.
Confirmed COP nature trail – priority
Placement of seating along pedestrian paths, 1- corner of Heath/Grant St on tarmac pad where former seat located, 2- Mossy Point headland walk. Look into repurposing seats and contacting Banksia Village to consider a joint project with 50/50 funding.
6. Request Council for an onsite meeting to strongly consider a long term solution to the drainage problem on Coronation Drive, and to revisit the upgrade and accessibility to the viewing platform at Nth Broulee as detailed in a letter in 2016.
6. Street trees and wildlife boxes. Follow up earlier requests to Council and query Council’s policy on street trees, and whether Section 94 money is allocated for same.
7. Insurance – enquiry to Dept of Fair Trading, it is not mandatory for NFP organisations to have insurance, up to the membership and assessment of risk. AON Insurance have tailored policies for voluntary associations, and public liability would cost about $700. The activities undertaken by BMPCA are covered by public liability insurance held by partner bodies, eg Council, Surf club. May seek legal advice for further consideration of this matter.
8. Fundraising flyer – waiting on redesign.

Broulee Mossy Point Community Association General Meeting
Thursday 29th November 2018

Meeting opened at 8pm after presentation by Kelwyn White from the RFS
Attendance as per register, and  apologies  noted.
Confirmation of minutes of 20th September, moved V Fisher, 2nd B Schaef, carried.

President’s Report.
Mossy point pathway payment was handed over on site to Warren Sharpe on 2nd November. There is some concern at vehicles parking on the pathway blocking pedestrians, needs some education of locals and visitors. Clr Mayne to take it to the Roads and Traffic committee of Council.

Capt. Oldrey Park Master plan was adopted by Council on Tuesday 27th November, it is generally a plan the community can live with. At the last consultation with user groups, Council was urged to look elsewhere in coming years for further sporting oval development, not on environmentally sensitive land. It was acknowledged that Council did listen to the community, but has to balance competing needs, and discussion will continue, particularly when it comes to the road reserve. The open space in the Master plan to the west of COP will permit utility development, [sewage, pumping station, stormwater retention etc,] but not housing.
 
It was noted that the vote on COP was not unanimous, an amendment by Clr McGinlay to remove the future oval from the plan, retaining the Bangalay forest was lost.

President Ross addressed residents of Banksia Village to inform them about the community association, and noted that BMPCA can contribute items for their internal newsletter, and the Association may consider holding a meeting at the village if agreed to.

Treasurers Report.
Pathway Acc.  $717.09, incoming : $270.00 from theatre day, $280.00 from sausage sizzle, plus $100.00 donation from Mossy Point resident.
General Acc. $5,311.00.

General Business :
  • Fundraising information flyer approved with membership form on the back. To approach Tomakin club for assistance with printing.  Moved V Fisher, 2nd. R Hayward.
  • Art on the Path, Sunday 16th December, volunteers needed for sausage sizzle.
  • Bay to Breakers Swim, Sunday 10th March 2019 volunteers needed.
  • Sandcastle Competition, Monday 31st December [New Years Eve] low tide 11.30AM. John and Deb Waser have it in hand and Council have agreed to cover the licence fee, ESC to be invoiced by the Association. Entry fee to be raised from $5.00 to $10.00. Moved D.Waser, 2nd B Roberts.  Carried.   BMPCA volunteer to circulate with donation bucket on the day.
  • Concern was raised at lack of insurance held by the Association. Does the Fair Trading Act give protection? Richard Roberts will seek clarification and if necessary get quotes.

Confirmation of meeting Minutes of 10th May 2018.
Moved Shirley Read, 2nd Vince Fisher that the Minutes of 10th May 2018 be accepted. Carried.

Correspondence:  Out – To ESC on CAMP, and Items from last meeting.
In – email from Councillor Mayne, Letter from resident on trucks parked off Train St.

General Business
Motions from the Treasurer 1. That BMPCA donate $400 to Broulee Public School for the use of their premises. Moved Ross Hayward, 2nd Lynn Bain. Carried.

That the pathway payment of $16,000 be paid by 2 cheques, $14,000 from the Pathway account, and $2,000 from the General account. Moved Ross Hayward, 2nd Bev Paris. Carried.

A query and discussion followed on the $ value of contributions to the local community made by BMPCA over recent years, and Lindsay Boyton will prepare a list to inform the community.
Motion; BMPCA prepare a letterbox drop information sheet detailing financial contributions and ongoing projects that BMPCA has made to the local community.
Moved Vince Fisher, 2nd Lindsay Boyton. Carried.

Capt Oldrey Park Master Plan : 2 members of the executive will meet with Council staff and all other users of the park to look at the MP and discuss pros and cons. Much discussion on putting the Association’s view forward, with emphasis on offering a positive alternative to clearing for an oval, to developing an environmental education track with interpretive signing, for the benefit all, and working closely with Council to sensitively plan tree removal where necessary for expansion of the facilities. Submissions encouraged, due by 10th October.
 
Consider elevating the issue in view of membership size, go directly to the Mayor, and advocate for longer term planning for sporting ovals elsewhere.

Longer term strategy that the Association consider convening a new Management Committee for Capt. Oldrey Park with all users, apart from Council, to put a combined view.

Guys and Dolls Fundraiser : Matinee performance on 11th November.

Other Issues.
Parking on Train St. congested and safety issue with students from adjacent school. To raise the issue with ESC.

Candlagan RFS Open day Saturday/Sunday 22/23 September.

Derek Anderson proposed that the Association consider offering a donation to a local student Jaylah Hancock-Cameron who is attending the Youth Olympics in Buenos Aries, the current 1500m Australian Champion.

Motion: The Association agree to give a donation to Jaylah Hancock-Cameron if affordable after examination of the accounts. Moved Derek Anderson, 2nd Roger Gribble. Carried.

Art on the Path – Sunday 30th September, BMPCA responsible for BBQ. Volunteers Bruce, Derek, Richard. To have achievement list on display and tickets for Guys and Dolls.

Request for pedestrian path for safe access from Heath St. to Broulee supermarket/PO on western side of Coronation Drive be raised with ESC.

Report on long term strategy for Eurobodalla water supply tabled.
